Nelson urges jurors not to consider lesser charge against Wright

Minnehaha County State’s Attorney Dave Nelson concluded his closing arguments by asking jurors not to consider a lesser charge against Daphne Wright, who is accused of murdering Darlene VanderGiesen.

Nelson said a compromise verdict – one that would end the possibility of capital punishment – would not serve justice.

Though Wright is charged with first-degree murder, jurors have the option of finding her guilty of a lesser charge such as second-degree murder.

Nelson also asked jurors to dismiss “speculation and innuendo” the defense offered during six days of testimony.

The evidence does not point to an accidental fall, or to other suspects, Nelson said.
“There was nothing accidental about this case,” he said. “Her body was desecrated in ways that we can not find words to describe.”

Minnehaha County Public Defender Traci Smith was preparing to begin her closing argument.

The jury could get the case as early as 5 p.m. today.
